These Terms & Conditions of Sale apply to purchases of products and services offered through different-shop.hr and to orders placed with us following an enquiry, quotation or other direct communication.

For the purposes of these Terms, “Different Shop”, “we”, “us” and “our” refer to the seller identified above.

By placing an order, the customer confirms that they have read and accepted these Terms & Conditions of Sale.

1. Products and Services

Different Shop offers both standard and custom-made products.

Our range includes products available directly through the online shop as well as products manufactured, modified or configured according to customer specifications.

Depending on the product, an order may include services such as design preparation, custom manufacturing, finishing, assembly, packaging, delivery or installation.

Product characteristics, materials, dimensions, available options and other relevant information are described on the applicable product page, quotation, specification, drawing or order confirmation.

2. How Orders Can Be Placed

Customers may place or initiate orders through:

  • direct checkout on different-shop.hr;

  • a request for quotation;

  • email;

  • telephone;

  • direct communication with our team; or

  • approval of a quotation, design, drawing or specification prepared for a custom project.

The ordering process may differ depending on whether the customer is purchasing a standard product or commissioning a custom-made product.

3. Standard Webshop Orders

Products available for direct purchase may be ordered through the checkout process on different-shop.hr.

Before submitting an order, customers are responsible for reviewing the selected products, quantities, dimensions, options, delivery information and total price.

Submission of an order does not prevent us from correcting an obvious technical, pricing or availability error where permitted by applicable law.

The customer will receive an electronic confirmation relating to the order.

4. Custom Orders

Custom products include products manufactured, cut, engraved, printed, illuminated, finished, personalised or otherwise produced according to customer specifications.

Examples may include custom signage, yacht and boat names, boat windows and windscreens, acrylic components, products made to specific dimensions and products incorporating customer-provided text, graphics, logos or designs.

A custom order may require us to prepare a quotation, drawing, design proposal, technical specification or other documentation before production.

Unless otherwise agreed in writing, a custom order is considered confirmed after the required payment has been received.

Production will not normally begin before payment and any required customer approvals have been received.

5. Customer Specifications and Measurements

Customers are responsible for ensuring that all information supplied for an order is accurate.

This may include:

  • dimensions and measurements;

  • quantities;

  • product configuration;

  • text and spelling;

  • names;

  • colours;

  • materials and finishes;

  • mounting requirements;

  • electrical requirements;

  • drawings and technical specifications;

  • logos and artwork;

  • photographs and reference materials; and

  • delivery information.

Where a product is manufactured according to dimensions or specifications supplied by the customer, Different Shop is not responsible for errors resulting from incorrect information supplied by the customer.

Customers should carefully verify all measurements before approving a custom order.

Where necessary, we may request additional information before production begins.

6. Design and Customer Approval

For certain custom products, we may provide a drawing, visualisation, proof, layout or specification for approval.

The customer is responsible for checking the information shown before approval, including dimensions, text, spelling, positioning, colours, quantities and other relevant specifications.

Once approved, the supplied or approved documentation may be used as the basis for production.

Changes requested after approval or after production has started may result in additional costs and may extend the production time.

If production has already progressed to a point where a requested change cannot reasonably be implemented, we may be unable to accept the change.

7. Prices

Prices applicable to direct webshop purchases are displayed on different-shop.hr.

Custom products and services may be priced individually based on specifications, dimensions, materials, quantities, complexity, finishing, delivery, installation and other project requirements.

The price applicable to a custom order will be stated in the relevant quotation or order confirmation.

Additional services or requirements that were not included in the original order or quotation may be charged separately with the customer’s agreement.

8. Quotations

Unless otherwise stated on the quotation, quotations are based on the information available to us at the time they are prepared.

If the customer subsequently changes the dimensions, quantity, materials, design, installation requirements, delivery location or other specifications, the price and production schedule may be revised.

A quotation does not reserve production capacity indefinitely.

9. Payment

We currently accept:

  • online card payment; and

  • bank transfer.

Available payment methods may depend on the type of order and the customer’s location.

Payment instructions for bank transfers will be provided during checkout, on the quotation, invoice or through direct communication.

Customers are responsible for any bank charges imposed by their own bank or payment provider.

Custom orders are considered confirmed once the required payment has been received, unless otherwise agreed in writing.

10. Production Times

Production times vary depending on the product.

Estimated production times may be displayed on a product page, stated in a quotation or communicated directly to the customer.

Custom products may require additional production time depending on their complexity, quantity, materials, current production workload and any required customer approvals.

Any estimated production period begins only after we have received:

  1. the required payment;

  2. all information necessary for production; and

  3. any required customer approval.

Where circumstances outside our reasonable control affect production, we will make reasonable efforts to inform the customer.

11. Delivery Area

Different Shop delivers products throughout Europe, including EU and non-EU European countries, subject to product, destination, carrier and shipping restrictions.

Certain oversized, fragile, heavy or otherwise specialised products may not be eligible for standard delivery methods.

In these situations, delivery arrangements and costs may be agreed individually with the customer.

12. Delivery Times and Costs

Delivery times and costs depend on the product, package dimensions, weight, destination and selected delivery method.

Where available, delivery costs will be displayed during checkout.

For custom, oversized or specialised orders, delivery costs may instead be included in or added to an individual quotation.

Production time and transport time are separate. An estimated production completion date should therefore not automatically be interpreted as the final delivery date.

Any delivery dates provided are estimates unless a specific binding delivery date has been expressly agreed.

13. Non-EU Deliveries

Orders delivered outside the European Union may be subject to customs procedures, import VAT, customs duties, brokerage fees or other charges imposed by the destination country.

Customs procedures may also cause delays outside our control.

Customers ordering from outside the European Union are responsible for ensuring that the ordered products may legally be imported and used in their destination country.

14. Delivery and Inspection

Customers should inspect delivered packages and products as soon as reasonably possible after receipt.

If a package appears visibly damaged during transport, the customer should document the condition of the package and product with photographs and notify us as soon as possible.

Customers should retain the original packaging where reasonably possible until a transport-damage claim has been resolved.

Nothing in this section limits any mandatory statutory rights available to consumers.

15. Installation

Some products may be supplied with installation services, while others are supplied for installation by the customer or a third party.

Installation is included only where this is expressly stated in the product description, quotation or order confirmation.

Where Different Shop performs installation, project-specific conditions such as access, site preparation, electrical connections, mounting surfaces, travel and equipment requirements may be agreed separately.

Where the customer or a third party performs installation, installation instructions provided with the product should be followed where applicable.

Different Shop cannot be held responsible for damage resulting solely from incorrect installation, modification or use contrary to supplied instructions, subject always to mandatory applicable law.

16. Custom-Made and Personalised Products

Customers should be aware that products manufactured according to their specifications or clearly personalised may be subject to different cancellation and withdrawal rules than standard products.

Under applicable consumer protection law, the statutory right of withdrawal may not apply to goods made to the consumer’s specifications or clearly personalised.

This can include, depending on the circumstances, products manufactured to customer-specified dimensions, personalised yacht or boat names, custom signs, custom-cut windows and other individually manufactured products.

The applicable rules and procedures are explained in our Returns, Refunds & Complaints Policy.

This does not affect the customer’s statutory rights regarding defective or non-conforming goods.

17. Product Appearance and Manufacturing Tolerances

Photographs, renders, illustrations and digital previews are intended to provide a reasonable representation of our products.

Actual appearance may vary slightly due to lighting, photography, display settings, material batches, manufacturing processes and characteristics inherent to the material.

Custom-manufactured products may also be subject to reasonable manufacturing tolerances appropriate to the relevant material and production process.

Such minor variations do not automatically constitute a defect where the product otherwise conforms to the agreed specifications and applicable legal requirements.

18. Intellectual Property and Customer Materials

Customers who provide logos, artwork, photographs, designs, trademarks or other materials for production confirm that they have the necessary rights or permission to use those materials for the requested purpose.

The customer is responsible for claims resulting from materials they supplied without the necessary rights, to the extent permitted by applicable law.

Our own designs, drawings, technical solutions, photographs and other intellectual property remain protected under applicable intellectual property laws unless otherwise agreed in writing.

19. Consumer Rights

Nothing in these Terms is intended to exclude, restrict or reduce mandatory consumer rights provided under Croatian or applicable European Union law.

Where these Terms conflict with mandatory consumer protection legislation, the mandatory legal provisions will apply.

20. Business Customers

Where a customer purchases products primarily for purposes relating to their trade, business, craft or profession, different statutory rules may apply than those applicable to consumers.

Mandatory consumer rights described on the Website apply where the purchaser qualifies as a consumer under applicable law.

Project-specific B2B arrangements may additionally be governed by an accepted quotation, specification, contract or other written agreement.

21. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Different Shop is not responsible for losses caused by incorrect specifications, dimensions, files or instructions supplied or approved by the customer, except where the loss is attributable to our own failure to comply with applicable contractual or legal obligations.

We are not responsible for delays caused exclusively by circumstances outside our reasonable control, including carrier disruption, customs procedures, natural events or other events that could not reasonably have been prevented.

22. Changes to These Terms

We may update these Terms & Conditions of Sale to reflect changes in our business, Website, services or applicable legal requirements.

The version applicable to an order is the version made available to the customer at the time the relevant contract is concluded, unless mandatory law requires otherwise.

23. Governing Law

These Terms are governed by the laws of the Republic of Croatia and applicable European Union law.

Nothing in these Terms restricts mandatory consumer rights, including any rights concerning applicable law or jurisdiction that cannot legally be excluded by agreement.
